On March 18th, The Human Line Project called the Vancouver police department on me claiming, without merit, that I was in “psychosis.” Luckily, the Vancouver PD has a special team for these types of calls that is staffed with mental health care professionals instead of criminal police officers. However, in many jurisdictions, police often escalate with the potential for serious violence. This call was not a good faith report for someone they thought was actually in danger. This call was intended to intimidate and harm me and I consider it a serious threat to my wellbeing.
Making false reports to the police is a crime under Canadian law. This offence is known as public mischief and is defined under Section 140 of the Criminal Code of Canada. It applies when someone intentionally misleads a peace officer by:
- Making a false statement that accuses another person of committing an offence;
- Reporting a crime that never occurred;
- Causing someone else to be suspected of a crime they did not commit;
Consequences:
- Public mischief is a hybrid offence, meaning it can be prosecuted as either a summary conviction or an indictable offence.
- If treated as an indictable offence, the maximum penalty is 5 years in prison.
- The offence is taken seriously because it wastes valuable police resources, can lead to innocent people being wrongfully arrested, and undermines public trust in law enforcement.
Intentionally providing false information to police, such as reporting a law abiding citizen as a psychotic person in order to infringe upon their free speech, remains a criminal act.
Commenting on things YOU have chosen to make public IN THE PRESS is not invasion of privacy, harassment or defamation. You entered the public square. The public has a right to respond to the veracity of your statements. it is called free speech and I will not be intimidated out of my legal right to express it. If you can’t hang with the big dogs, you better get on the porch with the pups.
Further, any individuals aiding and abetting Ms. Stern’s harassment and smear campaign against me open themselves up to charges of civil conspiracy.
I will protect myself to the FULLEST extent of the law.
